These terms govern your use of the Morning Song mobile application, published by Vittori, an independent developer registered in Georgia ("we", "us"). By installing or using the app you agree to them. If you do not, please do not use the app.
1. What the app does
Morning Song is an alarm clock. You describe what is coming tomorrow; the app uses artificial intelligence to write and perform a short song about it, and plays that song when the alarm goes off.
2. No account
There is no registration. The app identifies your installation by a random identifier it generates on first launch. Your entitlements — trial songs, credits, subscription — are attached to that identifier and to nothing else.
This matters if you change phones. Because there is no account, purchases and unspent credits cannot be moved to another installation by us. A Morning Song Plus subscription can be restored on a new device through Google Play, as it is tied to your Google account; individual credit packs cannot.
3. Free trial
Each installation may generate three songs free, once, for the lifetime of that installation. Trial songs are limited to 12 seconds. The trial does not renew.
4. Morning Song Plus
Plus is an auto-renewing subscription sold through Google Play:
- US $6.99 per month, or US $49.99 per year. Prices in other countries are set in local currency and shown in the app before you buy.
- 30 songs per billing period. The count resets when the subscription renews, not on a calendar month. Unused songs do not carry over.
- Up to 5 style profiles.
- Songs of up to 45 seconds.
The subscription renews automatically until you cancel. You can cancel at any time in Google Play; cancellation takes effect at the end of the period you have already paid for, and you keep Plus until then. We do not cancel it for you and cannot do so on your behalf.
5. Credit packs
Credit packs are one-off purchases: 10 songs for US $4.99, 25 for US $9.99, or 60 for US $19.99. Credits do not expire. They are spent only after the free trial and, if you subscribe, after that period's included songs are used up.
How a song is counted. One credit buys up to 20 seconds of song. A longer song costs more than one credit — a 30-second song costs two, a 45-second song costs three — and is always paid for in whole credits from a single source. The cost is shown before you generate.
6. Payment and refunds
All payments are processed by Google Play, which is the seller of record. We never see or hold your payment details. Refunds are governed by Google Play's refund policy and are requested through Google, not through us. If a song you paid for was not delivered because of a fault on our side, write to us and we will restore the credits.
7. Songs, and what you may do with them
We claim no ownership of the songs generated for you. You may keep them, play them and share them for your own personal, non-commercial use. Because the audio and lyrics are produced by third-party AI models, we cannot guarantee that any given song is free of resemblance to existing work, and we make no promise that you hold exclusive or commercial rights in it. Do not use generated songs commercially without taking your own advice.
8. Acceptable use
Do not use the app to generate content that is unlawful, hateful, harassing, sexually explicit involving minors, or that infringes someone else's rights. Do not attempt to extract our API credentials, circumvent the payment or quota system, or automate the service. We may stop serving an installation that does these things.
9. The alarm — please read this one
Morning Song is an ordinary Android application. Whether an alarm actually rings depends on your device: battery optimisation, Do Not Disturb, permission to schedule exact alarms, notification settings, silent or restricted modes, and the phone being switched on and charged. Some manufacturers stop background apps aggressively.
Do not rely on this app alone to wake you for anything that matters. For flights, exams, medication, shift work or any other situation where failing to wake has real consequences, set a second, independent alarm. We are not liable for a missed alarm.
10. Availability
The app depends on external services for writing and performing songs. Generation may be slow, may fail, or may be temporarily unavailable. When a generation fails, the credit is not spent. Alarms and previously downloaded songs keep working without a network connection.
11. Privacy
Our handling of data is described in the Privacy Policy, which forms part of these terms.
12. Disclaimer and liability
The app is provided "as is", without warranties of any kind to the fullest extent the law allows. To the extent permitted by law, our total liability to you for any claim arising out of the app is limited to the amount you paid us for it in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you.
13. Ending things
You may stop using the app at any time by uninstalling it, and delete your data as described in the Privacy Policy. We may suspend or discontinue the service; if we discontinue it entirely we will say so in the app or on this site with reasonable notice.
14. Governing law
These terms are governed by the law of Georgia, without regard to its conflict of law rules. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory rules of your own country's law.
15. Changes
We may update these terms. The date above shows the current version, and material changes will be noted in the app's release notes. Continuing to use the app after a change means you accept it.
